Former Ranchito Pickin Chicken cook alleges he was wrongfully terminated

PHILADELPHIA – A Philadelphia man alleges a restaurant chain in the city owes him unpaid wages and unlawfully terminated him after being injured on the job.

Eusebio Garcia filed a complaint on July 25 in the U.S. District Court for the Eastern District of Pennsylvania against Ranchitos Restaurant LLC, doing business as The Ranchito Pickin Chicken, and Isidro Gomez alleging violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiff began working for the defendant in October 2014 as a cook. He alleges he worked approximately 80 hours a week without being paid overtime at a rate of time-and-one-half. The suit also states that the defendant terminated the plaintiff's employment after he requested medical leave to care for a hand injury sustained at work in October 2015.

The plaintiff holds Ranchitos Restaurant LLC and Gomez responsible because the defendants allegedly failed to pay overtime wages, failed to maintain accurate records regarding the hours plaintiff worked and terminated him because of his disability.

The plaintiff requests a trial by jury and seeks back wages, front pay no less than $150,000, compensatory damages, punitive damages, interest, court costs and any further relief this court grants. He is represented by Michael Murphy and Michael Groh of Murphy Law Group LLC in Philadelphia.
