PHILADELPHIA – A weight loss and wellness program company alleges that it has been damaged by statements made about its product on "The Dr. Oz Show."

GOLO LLC filed a complaint on July 31 in the U.S. District Court for the Eastern District of Pennsylvania against ZoCo Productions LLC; Harpo Productions Inc.; Mehmet Oz, M.D.; and Keri Glassman alleging unfair competition, false advertising and other counts.

According to the complaint, the plaintiff sells a weight loss and wellness program under the GOLO name. The suit states that in July, Harpo and ZoCo published a review of the plaintiff's product on the Dr. Oz website as part of a slideshow that the plaintiff alleges contains false statements. Also in July, the plaintiff alleges its product was reviewed on "The Dr. Oz Show" that also contained false and misleading statements.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory and punitive damages, court costs and any further relief the court grants. It is represented by M. Kelly Tillery of Pepper Hamilton LLP in Philadelphia.
