Individual claims Unum terminated disability benefits despite medical evidence

PHILADELPHIA – A Philadelphia woman alleges that her disability benefits were wrongfully terminated.

Lisa Markocki filed a complaint on July 31 in the U.S. District Court for the Eastern District of Pennsylvania against Unum and Unum Life Insurance Co. of America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff was injured in a trip and fall accident in October 2013 and applied for short and long-term disability benefits with the defendants. She alleges she received long-term disability benefits until Sept. 29, 2016, when they were terminated by the defendant.

The plaintiff holds Unum and Unum Life Insurance Co. of America responsible because the defendants allegedly terminated plaintiff's disability benefits despite her appeal and despite having sufficient medical evidence of her disability.

The plaintiff seeks declaration that she is entitled to coverage, damages and payment of all disability benefits, interest, court costs and any further relief the court grants. She is represented by Marc A. Weinberg of Saffren & Weinberg in Jenkintown.
