Insurance 10

ERIE – A Latrobe man alleges that his claim for disability benefits was wrongfully denied.

Daniel Porembka filed a complaint on Aug. 11 in the U.S. District Court for the Western District of Pennsylvania against Liberty Life Assurance Co. of Boston alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled in March 2014. The suit states he receives disability benefits from the Social Security Administration but that the defendant denied his claim for benefits in June 2016.

The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly ignored medical evidence and did not conduct a full and fair review of the claim.

The plaintiff seeks award benefits due to the plaintiff, interest, court costs and any further relief the court grants. He is represented by Jessica L. Rafferty of QuatriniRafferty PC in Greensburg.
