PITTSBURGH – A man alleges he was misclassified as an independent contractor by his former employer.

Dennis Kolasa filed a complaint on behalf of all others similarly situated on Aug. 18 in the U.S. District Court for the Western District of Pennsylvania against Bos Solutions Inc. alleging violation of the Fair Labor Standards Act and other counts.

According to the complaint, the plaintiff was employed by the defendant as a solids control technician from January 2014 to June 2015. He alleges he was paid a day rate and misclassified as an independent contractor. The plaintiff holds Bos Solutions Inc. responsible because the defendant allegedly failed to pay overtime wages to the plaintiff.

The plaintiff requests a trial by jury and seeks unpaid back wages, liquidated damages, court costs, interest and any further relief the court grants. He is represented by Joshua P. Geist of Goodrich & Geist PC in Pittsburgh.
