Ground Penetration and Restoration Inc. alleged to have breached agreement with union funds

PHILADELPHIA – A Philadelphia company is alleged to owe contributions to several labor union funds.

The Laborers' District Council Construction Industry Pension Fund, the Laborers' District Council Heavy and Highway Health and Welfare Fund, et al. filed a complaint on Aug. 24 in the U.S. District Court for the Eastern District of Pennsylvania against Ground Penetration and Restoration Inc. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs obtained a judgment in their favor on April 19, 2016, against the defendant and entered into an agreement in October 2016. The plaintiffs allege that the defendant breached this agreement and owes $38,447.50. The plaintiffs also allege that the defendant owes unpaid contributions from April 2015.

The plaintiffs seek judgment against the defendant in the amount of $38,447.50 plus interest at the rate of 6 percent, and any further relief the court grants. They are represented by Nancy L. Goldstein of Hamburg & Golden PC in Philadelphia.
