ERIE – A Leetsdale partnership alleges a Canada company's mark for hair care products is likely to cause confusion.
FramKat LP and Framesi SpA filed a complaint on Aug. 22 in the U.S. District Court for the Western District of Pennsylvania against Framar International Inc. alleging trademark infringement.
According to the complaint, the Framesi mark has been used in the United States since 1976 for hair care and hair styling products. The plaintiffs allege that the defendant's use of the Framar mark is likely to cause confusion with Framesi's registered Framesi and Framcolor marks.
The plaintiff requests a trial by jury and seeks enjoin and restrain the defendants, all profits, court costs and any further relief the court grants. They are represented by Kevin P. Allen and Timothy P. Ryan of Eckert Seamans Cherin & Mellott LLC in Pittsburgh.
