Woman claims Life Insurance Co. of North America wrongfully denied short-term disability

PHILADELPHIA – A Bryn Mawr woman alleges she is currently disabled because of migraine headaches and that her claim for short-term disability benefits was wrongfully denied.

Sharon Rudo filed a complaint on Aug. 28 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she suffers from severe pain due to migraine headaches and chronic and debilitating headaches despite taking medications. The suit states she submitted a claim for short-term disability benefits on Jan. 27 to the defendant but the defendant denied the claim on March 20.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny plaintiff's claim for short-term disability benefits despite having sufficient medical records to support her claim.

The plaintiff seeks damages due to her, interest, court costs and any further relief the court grants. She is represented by Francesco P. Trapani of Kreher & Trapani LLP in Philadelphia.
