Lawsuit: Bail bond management group says it's owed more than $50K after prisoner skipped court date

PHILADELPHIA – A bail bond management company claims it is out more than $50,000, due to a non-payment of that amount from three defendants who took out that bond for a fourth party and were responsible for its subsequent forfeiture.

ABC Bail Bonds, Inc. (corporately, of Morrisville) filed suit in the Philadelphia County Court of Common Pleas on Sept. 5 versus Robert Jordan, Terrell Bell and Mohamed Conteh, all of Philadelphia.

On an unspecified date, the defendants purchased a bail bond at the plaintiff’s Philadelphia office in the amount of $50,000 in the name of Tyriek Bond. The trio signed an indemnity agreement outlining the terms, conditions and requirements to have Bond released from prison.

Thus, the plaintiff posted a bail bond in the amount of $50,000 in Philadelphia, in Bond’s name. The above-referenced bail bond was sold to defendants for a total fee of $5,010, with an initial payment of $1,800 and $3,210 was agreed to be paid in installments.

However, Bond failed to appear for his scheduled date in Philadelphia Municipal Court, on Aug. 15. This was a direct breach of the condition set up by the contract and terms of Bond’s release.

This led the Philadelphia Municipal Court to approve a motion to revoke and forfeit Bond’s bail. The plaintiff undertook efforts to have Bond appear to correct the bail forfeiture, but was unsuccessful in doing so, though the agreement stated fulfilling the bail's conditions was originally the defendants’ responsibility.

Due to Bond’s failure to appear in court and the resulting forfeiture, the face amount of the bond has become due, which is $50,000. In addition to the face amount of the bond, there is an outstanding balance on the installment agreement for the payment of said bond, which is $3,210.

For two counts of breach of contract, the plaintiff is seeking damages of $53,210, plus costs of suit and such further relief as the Court may deem equitable and just.

The plaintiff is represented by Ethan P. Henshell of ABC Bail Bonds, Inc., in Morrisville.
