Rhoads Industries Inc., Rhoads Marine Industries allege Navy project damaged property

PHILADELPHIA - Two Philadelphia businesses allege a federal project damaged their property.

Rhoads Industries Inc. and Rhoads Marine Industries Inc. filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania Sept. 11 against United States of America, citing the Suits in Admiralty Act.

According to the complaint, the U.S. Navy hired contractors to conduct pile driving to rehabilitate a large basin on a property adjacent to the plaintiffs' in 2009. The plaintiffs allege this project caused a large subsidence to form on their property and caused damages.

The plaintiffs hold United States of America responsible because they claim the defendant is strictly liable for the damages caused.

The plaintiffs seek judgment against the defendant in an amount of more than $75,000, interest and court costs. They are represented by Jay M. Levin and Brian M. Collins of Offit Kurman in Philadelphia and by representatives of the same firm in Plymouth Meeting.
