WILLIAMSPORT – A seller of pain relief creams is alleged to have engaged in illegal telemarketing.
Gwendolynn M. English filed a complaint on behalf of all others similarly situated on Jan. 25 in the U.S. District Court for the Middle District of Pennsylvania against Assured RX LLC alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in September 2017, she received several unwanted calls from the defendant using a pre-recorded message. She alleges she is not a customer of the defendant.
The plaintiff holds Assured RX LLC responsible because the defendant allegedly made several telemarketing calls to the plaintiff's cellular telephone without her consent.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, injunctive relief, $1,500 as treble damages, court costs and any further relief this court grants. She is represented by Stephen P. DeNittis and Ross H. Schmierer of DeNittis Osefchen Prince PC in Philadelphia.
