Security systems at issue in Pittsburgh class action

PITTSBURGH – A company is facing allegations of breach of warranty and negligent misrepresentation in the installation of a system alleged to be accessible to improper parties.

The lawsuit against 2 Krew Security & Surveillance was filed Feb. 13 in U.S. District Court for the Western District of Pennsylvania.

“The (security) systems were defective in design and manufacture, insofar that the 'master code' that turned off each system was common to all the systems that the defendant sold, and thus, any system sold by defendant was susceptible to a breach by any person or business with the same system,” the court brief read.

The plaintiff Bergad Inc. a medical foam company based in Kittanning, filed the lawsuit.

The suit is a proposed class action; in excess of 100 persons could be affected.

The defendant is in the business of designing and installing intelligent systems tailored to new businesses, residential homes, and franchises, as well as industrial, educational, municipal, state, and federal government agencies.

“There may be thousands of structures in Pennsylvania and throughout the United States with the defective systems installed,” attorneys for the plaintiff noted. “The members of the class have suffered actual damages in that they have purchased these systems of inferior quality which they would not have purchased at all if they had known of the true quality of the systems and must now have the systems replaced.”

The plaintiffs are asking the court for compensatory damages for the class, pre-judgment and post-judgment interest; reasonable attorneys’ fees and further relief as the court deems just and proper.
