Drunk driver who suffered injuries in crash, arrested for DUI sues bar that served her alcohol

SCRANTON — A woman who became intoxicated, drove with a blood alcohol level that was three times the legal limit then crashed her vehicle and suffered severe injuries, is suing the bar that served her the alcohol. 

Terry Plonski filed a complaint Aug. 3 in the Court of Common Pleas for Lackawanna County against The Penalty Box Tavern Inc., alleging negligence. 

Plonski alleges in her complaint that she was at The Penalty Box Tavern located on Pittston Avenue in Scranton on July 28, 2020. She alleges that she arrived at the tavern at 8:30 p.m. and continued to be served alcoholic beverages until 2 a.m. and became intoxicated. 

Plonski claims that she left the tavern while "visibly intoxicated," drove her vehicle on the highways and shortly after, crashed her car while on Interstate 380. Specifically, Plonski alleges that she drove into another lane when her car struck a cable guide in the median, went through the cable guide and returned to the middle of the interstate. 

She further alleges she was arrested for D.U.I., with a blood alcohol level three times the legal limit and suffered injuries to her head, neck and suffered a traumatic brain injury. Plonski claims the defendant's negligence for failing to monitor or limit her consumption of alcohol, failing to train and supervise its employees, for not ensuring that she did not operate a vehicle and for not calling alternate transportation. 

Plonski seeks monetary relief of more than $75,000, interest, trial by jury and all other just relief. She is represented by Michael Goffer of The Law Offices of Goffer & Cimini in Scranton.
