Woman alleges poor lighting, no handrails caused fall down steps at AMC theater

PHILADELPHIA — A moviegoer alleges an AMC theater in North Wales failed to have proper handrails and lighting, which caused her to fall down a set of steps and suffer serious injuries. 

Peggy Rose filed a complaint in June in the Court of Common Pleas of Philadelphia County against AMC Theaters doing business as AMC 309 Cinema 9, John Doe (1-5) and others alleging premises liability. The defendant recently removed the case to Philadelphia federal court.

Rose alleges in her complaint that she was at the AMC 309 Cinema 9 on Bethlehem Pike in North Wales to see a movie on July 13, 2019. She claims that she tripped and fell down a set of steps and suffered severe injuries including to her bones, tendons, muscles, blood vessels, tissues and nerves. 

Rose alleges the defendants' negligence for failing to inspect their premises including the steps, walkways, handrails, lighting and other areas. She also alleges the defendants failed to correct a defective or dangerous condition or have ushers to assist movie goers to their seats. Rose further alleges that the defendants did not have visible railings and properly marked stairways and walkways and failed to properly train its employees. She claims that she has also suffered loss of earnings and incurred financial expenses as a result of her injuries. 

Rose seeks monetary relief of more than $50,000 and all other just relief. She is represented by Richard Stutman and Ricky Liss of Liss & Marion PC in Philadelphia.
