Lowe's customer claims ladder blocking aisles caused his fall, broken ribs

PITTSBURGH — A Lowe's customer who suffered fractured ribs after tripping over a ladder that was blocking the aisles is claiming negligence. 

Sean O'Rourke filed a complaint in the Court of Common Pleas of Allegheny County against Lowe's Home Centers LLC doing business as Lowe's alleging negligence. 

O'Rourke was at the Lowe's store on Baptist Road in Bethel Park on Aug. 7, 2020. He claims that he tripped over a metal rolling ladder that was blocking two aisles. O'Rourke further claims he landed sideways on the ladder's base and struck his rib and arm. 

He alleges as a result of the fall, he suffered a collapsed lung, fractured ribs and injuries to his wrist, arms and back. O'Rourke claims Lowe's was negligent for allowing the dangerous and defective condition to exist on its premises, failing to warn of the hazard and for failing to eliminate the dangerous condition in a timely manner. He also claims Lowe's failed to cordon off the dangerous condition and that they negligently maintained and operated its premises. O'Rourke alleges due to his injuries, he also suffered emotional and psychological trauma and has incurred large sums for medical treatment. 

O'Rourke seeks monetary relief, interest and all other just relief. He is represented by G. Christopher Apessos of Apessos Law LLC in Pittsburgh.
