Parents of girl who broke wrist and forearm at camp settle claims for $100K

SCRANTON – The parents of a 12-year-old girl who suffered a broken wrist and forearm due to a fall on the uneven bars at a Pennsylvania camp have settled their injury-related damages with the camp for $100,000.

Barry Hughes and Jodi Hughes (as parents and natural guardians of A.H., a minor) filed a petition in the Lackawanna County Court of Common Pleas on April 10 versus RRSC, Inc. (doing business as “Trail’s End Camp” and “Chestnut Lake Camp”).

“Petitioners, Barry Hughes and Jodi Hughes are the parents and natural guardian of minor petitioner, A.H. who was born on Aug. 16, 2011, and who is presently 12 years of age. Minor petitioner A.H. was injured on July 6, 2022 as the result of a fall on the uneven bars at the Chestnut Lake Camp in Beach Lake, Pennsylvania,” the petition said.

“As a result of the subject incident, the minor petitioner, A.H., suffered a closed, displaced right distal radial and ulnar shaft diaphyseal fracture. Petitioners reached a settlement with defendant on March 25, 2024, in the amount of $100,000, which sum the petitioners believe is in the best interest of the minor, considering all factors, including the risk and cost of litigation.”

The petition added the petitioners agreed to “deposit the settlement funds into an account in the name of the minor in banks, building and loan associations, savings and loan associations or credit unions which are insured by a federal governmental agency, or in one or more accounts in the name of minor investing only in securities guaranteed by the United States government or a federal governmental agency managed by responsible financial institutions.”

The petition outlined the distribution of the $100,000 settlement funds as follows:

• Less Costs – $158.50

• Less Lien to Optum – $1,476.51

• Less Attorney’s Fees (33 1/3%) – $33,333.33

• Net Amount to Barry Hughes and Jodi Hughes, As Parents and Natural Guardians of A.H., A Minor – $65,031.66

“Disclosure of terms is not a condition of the settlement and the petition and order therefore need not be sealed. Petitioners, Barry Hughes and Jodi Hughes, parents and natural guardians of the minor petitioner A.H., consent to this petition in the terms of settlement,” the petition stated.

The plaintiffs were represented by Vincent S. Cimini of Cognetti & Cimini, in Scranton.

The defendant did not have legal counsel listed.
