A Philadelphia man has filed a premises liability lawsuit against a city hotel for injuries he sustained after falling on an icy patch of sidewalk in front of the business.
Andrew H. Gaber, an attorney with The Gaber Law Offices P.C., filed the civil complaint May 10 in the Philadelphia Court of Common Pleas on behalf of Clyde Franks.
The defendants in the case are Hotel Sofitel Philadelphia, Accor Business and Leisure Management LLC, La Liberte LLC, South 17th Street Ownerco LLC and JMB Realty Corp.
According to the complaint, Franks was walking along the Sansom Street side of the property owned and/or operated by the defendant and defendants on Feb. 14, 2010 when he fell due to ice buildup on an uneven portion of the sidewalk.
The fall, which the lawsuit blames on the negligence of the defendants in not adequately maintaining the sidewalk, and ensuring it was free from ice, caused Franks to sustain injuries to his back, ribs, hip, legs, ankles and knees.
The plaintiff has incurred, and may in the future incur, additional expenses to treat his injuries, which the suit says caused him great pain and suffering, and may prevent him from attending to his daily activities and labors.
Franks demands judgment against the defendants, jointly and severally, in an amount not in excess of $50,000, plus court costs and delay damages, according to the complaint.
The non-jury matter is scheduled for an arbitration hearing on Jan. 12, 2012.
