Bottom of the Sea faces suit over mussels

A Philadelphia woman has filed a personal injury lawsuit against a city restaurant for alleged food poisoning she contracted after eating a meal at the eatery.

Philadelphia lawyer Adam M. Green filed the civil complaint May 17 at the Philadelphia Court of Common Pleas on behalf of client Tina Hairston.

The lawsuit accuses the Bottom of the Sea restaurant, located at 700 N. 43rd St., of negligence and carelessness for serving food that caused the plaintiff to become violently ill.

According to the complaint, Hairston was eating at the restaurant on June 27, 2010 when the mussels platter she had purchased caused her to become very ill.

Hairston at first attempted to treat her illness at home, but eventually had to be admitted to Lankenau Hospital in Wynnewood, Pa., on June 30, where she remained until July 3, 2010, the suit states.

As a result of the meal prepared by the restaurant, Hairston sustained infectious diarrhea, diffuse colitis and campylobacteriosis, and accompanying pain and anxiety, the suit states.

Hairston, the complaint alleges, has suffered pain and discomfort, frustration, embarrassment and a loss of life’s pleasures due to the incident, the suit says. She has also incurred significant medical costs.

The lawsuit contains two counts: negligence and strict liability. Hairston seeks damages in an amount in excess of $50,000 for each count, plus related costs and fees.

The plaintiff has demanded a jury trial.
