Private party-goer sues Phila. bar for assault by drunk patron

A Philadelphia man is suing a city bar for injuries he claims he sustained after an intoxicated, uninvited guest who crashed a private birthday party inside the establishment struck the plaintiff in the face.

Norristown, Pa. attorney David J. Picker filed the personal injury claim May 2 at the Philadelphia Court of Common Pleas on behalf of Rasheed Wilcox.

The defendant named in the civil action is Vault Ultra Lounge, which is located at 460 N. 2nd St. in Philadelphia.

According to the complaint, Wilcox went to the bar back on Aug. 13, 2011 to attend a private birthday party, which was being held in a separate area of the venue.

Despite the fact that the party was being held in a separate room, and that there was a security guard posted to make sure nobody who wasn’t invited to the event was granted admittance, a  drunk bar patron entered the birthday party and assaulted the plaintiff, the lawsuit claims.

Wilcox was struck “violently” at or about his face, the complaint alleges, which caused him to sustain various injuries that required him to spend money on medical treatment, the suit states.

The lawsuit accuses the defendant of negligence for serving alcohol to someone who was visibly intoxicated, failing to properly train its employees to recognize the signs of visible intoxication, failing to warn the intoxicated patron who assaulted the plaintiff that he was drunk and should not be allowed to move about the premises, failing to warn the plaintiff of the danger of the unknown individual, failing to prevent the intoxicated man from entering the private birthday party area, and failing to have the bar’s security personnel take the adequate steps to ensure no patrons other than the invited guests would be allowed at the party.

The lawsuit claims that Wilcox sustained a facial fracture and a severe shock to his nervous system, all of which required medical attention.

As a result of the incident, the lawsuit claims, Wilcox has suffered physical pain as well as mental anguish and humiliation.

Wilcox seeks compensatory damages in excess of $50,000, plus delay damages and costs.
