Northeastern Pa. man files asbestos claim in Philly courts

A Northeastern Pennsylvania man who was diagnosed with lung cancer nearly two years ago, a disease he attributes to his asbestos exposure during his working years, has filed a mass tort civil action against manufacturers of products containing the fiber.

Philadelphia attorney Edward M. Nass filed the personal injury complaint May 29 at the Philadelphia Court of Common Pleas on behalf of Peckville, Pa. resident Kenneth J. Prevish and his wife, Mary Ann Prevish.

The defendants named in the lawsuit are Honeywell International, Borg-Warner Corp., The Drever Group, Federal-Mogul Asbestos Personal Injury Trust, Foster-Wheeler Corp., John Crane Inc., Keeler/Dorr-Oliver Boiler Co., Metropolitan Life Insurance Co., Owens-Illinois Inc. and Warren Pumps LLC.

The lawsuit, which was filed as a short-form complaint in the master asbestos litigation at Common Pleas Court, states that Kenneth Prevish was diagnosed with lung cancer on Sept. 1, 2010, of which the plaintiff alleges asbestos was a factual cause.

Prevish, who is 74 years old, claims he was exposed to the fiber while serving in the U.S. Navy as a boiler tender from 1955 to 1958, and while performing vehicular maintenance work.

Prevish’s work history also includes time spent as a machine operator for various companies, including Bennett Products and A.P. Grossman, from 1958 to 1968, and as a truck driver and warehouse manager for Scranton Tobacco from 1963 to 1993.

The lawsuit states that discovery and investigation is continuing as to whether the plaintiff was exposed to asbestos in any other occupational settings or non-occupational settings.

The plaintiffs seek relief as stated in the master long form asbestos complaint at Philadelphia’s Common Pleas Court.
