Suburban Phila. woman sues over injuries suffered during car accident caused by sleeping behind the wheel

A woman from suburban Philadelphia is suing two people from North Jersey for injuries

she allegedly sustained after one of the defendants fell asleep behind the wheel and struck the plaintiff’s vehicle.

Ashley Wrzeszczynski, who resides in Trevose, Pa., which is located near the Philadelphia-Bucks County line, claims in her civil action, which was filed June 25 at the federal court in Philadelphia by Holland, Pa. attorney Steven E. Wolfe, that she suffered a variety of bodily injuries after Ridgefield, N.J. resident James Lee struck the plaintiff’s vehicle on Street Road near Mechanicsville Road in Bensalem, Pa.

The incident occurred on Aug. 24, 2010 at about 1:30 in the morning.

The complaint alleges that James Lee fell asleep behind the wheel of his 2004 Lexus, causing the vehicle to veer into the westbound lanes of Street Road, “violently” striking the plaintiff’s car and causing her to sustain severe bodily trauma including, but not limited to, chronic left shoulder pain, cervical radiculopathy, back sprains and pain, traumatic cephalgia and shock to her nervous system.

As a result of her injuries, Wrzeszczynski has been obliged to spend various sums of money on medical treatment, and she has suffered a loss of earning capacity and has been unable to perform her usual chores and activities, the lawsuit claims.

The plaintiff has also suffered mental, physical, emotional and psychological pain and distress, the suit claims.

The complaint accuses the defendants – Grace Lee is named as the second defendant – of carelessness, recklessness and negligence for driving a motor vehicle at an excessive speed, failing to keep a proper lookout, failing to have a motor vehicle under proper control, driving a motor vehicle while impaired, falling asleep behind the wheel and engaging in reckless driving.

Wrzeszczynski seeks damages in excess of $75,000, plus interest and the costs of the lawsuit.

She is demanding a trial by jury.
