A mass transit rider claims he was injured last winter after the bus in which he was riding
was struck from behind by a vehicle belonging to a cable service provider.
Michael Grasty, of Philadelphia, alleges in his civil action that on Feb. 28, 2011, while riding aboard a Southeastern Pennsylvania Transportation Authority bus along the 200 block of 52nd Street in Philadelphia, he was injured after a Comcast Cable truck that had been traveling at a high rate of speed slammed into the rear of the bus.
The lawsuit, which was filed Sept. 25 at the Philadelphia Court of Common Pleas by Philadelphia attorney Brian A. Wall, Jr., of the firm McCann Schaible & Wall, claims that as a result of the accident, Grasty sustained injuries including, but not limited to, lower back and left knee injuries, post-traumatic anxiety and shock and various other ills.
Chester, Pa. resident Iri Thomas, the Comcast employee or contractor who was operating the truck at the time, is named as a defendant in the complaint, as is Comcast Corp., Comcast Cable Communications Inc., Comcast Cable Co., Comcast Cablevision of Philadelphia Inc. and Ocean Cable Group Inc.
The lawsuit accuses the defendants of carelessness, negligence and recklessness for operating a motor vehicle at an excessive speed under the circumstances, failing to have a motor vehicle under proper and adequate control, failing to maintain a sharp lookout of the roadway and following too closely behind another vehicle.
The suit claims that Grasty has had to spend money on medical attention as a result of his injuries, and that he has suffered earnings losses due to his inability to properly attend to his job.
Grasty seeks judgment in excess of the arbitrational limits at state court, or $50,000.
