Phila. nightclub sued by patron struck in head by metal rod during altercation

A man from Upper Bucks County is suing a Philadelphia nightclub and a Lower Bucks County resident for injuries he allegedly sustained after being struck in the back of the head by the defendant during an altercation at the business last winter.

Farhaad Dildar, who resides in Perkasie, Pa., claims in his civil action that Bensalem resident Weislaw Kosinski struck him in the back of the head with a metal rod during a Jan. 23, 2011, incident outside of the Reina Disco Bar Nightclub at 11650 Roosevelt Boulevard in Philadelphia.

Kosinski and New Boulevard Diner, which owns and operates the nightclub, are named as defendants in the personal injury lawsuit, which was filed Nov. 5 at the Philadelphia Court of Common Pleas by Newtown, Pa. attorney Christopher J. Brill.

The complaint states that Dildar left the nightclub and went outside of the bar after he observed a fight taking place and a male patron lying on the ground.

Dildar leaned over to check to see if the victim was his cousin, the suit claims, when he was suddenly struck in the back of the head with a metal rod wielded by defendant Kosinski.

As a result of the incident, the plaintiff sustained lumbar fractures and chronic pain, as well as mental pain and suffering, emotional upset, worry, anxiety, apprehension, frustration, humiliation, embarrassment, inconvenience and a general loss of life’s pleasures and enjoyment, the complaint alleges.

Dildar also had to undergo medical care for the treatment of his physical injuries, the suit states, something that cost him a great deal of financial expense.

The plaintiff claims that his injuries were caused by the negligence, carelessness and recklessness of the defendants.

The nightclub is accused of failing to maintain control of the premises, failing to properly train and supervise employees, and failing to use reasonable care under the circumstances.

Kosinski is accused of striking the plaintiff in the back of the head with a metal rod without provocation or justification.

Dildar seeks compensatory and punitive damages in excess of $50,000, plus interest, costs and delay damages.

A jury trial is being demanded.
