Philly woman says slip and head injury caused by Ocean City grocery store

A Montgomery County woman claims that the improperly maintained floors at an Ocean City, N.J. grocery store heavily contributed to a concussion she suffered when she slipped on some liquid at the supermarket, according to a personal injury suit filed at the Philadelphia Court of Common Pleas.

Renee Rudnick, of Wyndmoor, Pa., and her husband, David, seek damages in excess of $50,000 for negligence and loss of consortium from the store's managing company, The Great Atlantic & Pacific Tea Company, Inc. (A&P) and the property's real estate owner YFP Ocean City.

According to the complaint, on July 4, 2012, Rudnick was shopping at the SuperFresh Supermarket on West Ave. in Ocean City, N.J. While walking down an aisle adjacent to shelves stocked with orange juice bottles, she slipped on an unknown liquid and fell to the floor, hitting her head on the ground.

The complaint says that the fall caused severe injuries to Rudnick, including a concussion and pain to her neck and back. The plaintiff alleges that the liquid came from malfunctioning refrigeration units. The store employees are accused of knowing about the problem but allowing the fluid to build up on the floor.

The defendants knew or should have known about the floor's condition, the complaint says, but their inattentiveness allowed the conditions to exist when Rudnick fell. Employees failed to inspect the floors and keep it clear of liquid substances, and they failed to repair the refrigeration systems and prevent the slippery substance from gathering on the floor in the first place, the plaintiff claims.

As a result, Rudnick has been forced to pay for rising medical expenses as she recovers from the incident, she claims. She also claims to have suffered a loss of past earnings and may not be able to bring in as much income as expected before the injury.
