Cleaning company sued over slip, says plaintiff filed it in the wrong court

PHILADELPHIA – A Reading couple have sued a pair of commercial cleaning and sanitation companies for negligence after the wife allegedly slipped on a wet floor in the course of her work duties.

Isabel De La Rosa and Octavio Linares initiated action against Giving Tree Commercial Cleaning of White Haven and Packers Sanitation Services of Kieler, Wis., in February.

On May 22, 2013, De La Rosa was employed at Hatfield Quality Meats in Hatfield. During her evening shift, De La Rosa slipped on a “dangerous, unmarked, wet floor” that she believed was cleaned by the defendants.

The defendant companies were charged with the regular cleaning of the premises, and De La Rosa alleges their negligence led to her accident.

De La Rosa allegedly suffered injuries to her neck, back, left shoulder, a left wrist fracture, thoracolumbar musculoskeletal strain and other orthopedic injuries, in addition to severe nervous system shock.

Further, De La Rosa’s spouse, Linares, is included in the lawsuit as filing for loss of consortium due to his wife’s injuries.

On March 12, defense counsel objected to the plaintiff’s lawsuit, feeling that it should not be heard in the Philadelphia County Court of Common Pleas.

Since the supposed fall happened in Hatfield, located in Montgomery County, the defendants argued improper venue.

An argument and evidentiary hearing in the case related to the issue of venue was scheduled to be held in the Court chambers at Philadelphia City Hall on Wednesday.

The plaintiffs are seeking an amount in excess of $50,000 in this case.

The plaintiffs are represented by Charles J. Schleifer and Robin Dawn Schleifer of Haggerty Goldberg & Schleifer, in Philadelphia.

The defendant is represented by Joseph B. Mayers and John F. Fox, Jr. in Blue Bell and Philadelphia, respectively.
