Ex-mail carrier sues U.S. Postal Service, alleging unjust termination

A Cumberland County resident is suing the U.S. Postal Service claiming that she was unjustly fired and that the union that represented her allegedly refused to back her claim.

Cynthia Powers of Mechanicsburg filed a lawsuit against the U.S. Postal Service and the National Association of Letter Carriers on Sept. 8 in the U.S. District Court for the Middle District of Pennsylvania, citing breach of contract and breach of duty of fair representation.

According to the lawsuit, Powers was a letter carrier from Nov. 8, 2014, until her termination March 7. On March 13, she contacted her local union, Branch 500 of NALC, requesting that they intervene on her behalf. She claimed that the union, under a collective bargaining agreement already in place, refused to challenge the alleged wrongful termination.

She is seeking a jury trial as well as an award thereafter for actual and compensatory damages resulting from her termination. She is being represented by Carlisle-based attorney Keith E. Kendall.
