Johnny Rockets accuses Johnny Rocks of trademark infringement

SCRANTON — A nationwide chain of '50s-style diners filed suit against a Philadelphia restaurant, alleging unlawful infringement of its trademark.

Johnny Rockets Licensing, LLC filed suit against Johnny Rocks Grill in the U.S. District Court for the Middle District of Pennsylvania on Sept. 14 alleging the Philadelphia restaurant too closely resembles the national chain of more than 200 franchises specializing in all-American food.

The plaintiff alleges it has made numerous requests for the defendant to change its name, but the defendant continues to refuse.

Johnny Rockets is seeking in excess of $75,000 in damages, plus punitive damages and attorney fees. The plaintiff is represented by Darious C. Gambino of DLA Piper (US), LLP in Philadelphia.
