PHILADELPHIA – A union in Bensalem and its trustee is suing a Philadelphia nursing center, which employs its members, over a claim that the center has failed to contribute to an employee trust fund for more than year, violating a collective bargaining agreement.

Retail, Wholesale, Department Store Union Local 1034 and its Welfare Trust Fund, along with trustee Gary Barker, filed a lawsuit on Nov. 4 in the U.S. District Court for the Eastern District of Pennsylvania against the Rest Haven Nursing Center, doing business as Andorra Woods, citing a violation of the Labor-Management Relations Act.

The union claims that an audit of Rest Haven’s payroll records revealed that from January 2012 through December 2013 no monies were contributed to an employee trust fund set up by the union for the nursing center’s workers. The lawsuit claims that the amount owed is $14,013.09, adding that the nursing center has been notified of the delinquency but has allegdly failed or refused to make the timely payments as required.
