Employee sues Heartland Pharmacy over discrimination claims

PHILADELPHIA – A Northampton woman is suing her employer after she claims was discriminated against for her age and fired in retaliation.

Shiva Novobilski filed a complaint on Nov. 19 in the U.S. District Court for the Eastern District of Pennsylvania against Heartland Pharmacy-PA LLC, Nina Grewel, Jerry Krbec, Chad Chamberlein and Christin Arcadipine, citing violations of the Age Discrimination in Employment Act and the Pennsylvania Human Relations Act.

Novobilski, 47, was hired by Heartland Pharmacy in June 2009, and during her time the plaintiff purports that she was repeatedly made the victim of age discrimination staring in 2013 by the defendants. Although she was an exemplary employee, Novobilski was denied desirable shifts and was not given a laptop as the other employees were, she was also treated worse than younger employees in the company, the claim states. When she began to voice concerns about the treatment and her discovery that the pharmacy was selling expired medications, she was allegedly terminated from her position in May, with the defendants accusing her of time theft, the complaint states. Novobilski is suing the pharmacy for its violation of age discrimination laws, as well as wrongful discharge.

Novobilski is seeking compensation for all damages suffered and legal fees paid. She is represented by Michael E. Alpago of Hahalis and Kounoupis, PC in Bethlehem.
