Media company claims former employee left for competitor, breached agreement

PHILADELPHIA – A New Jersey media company is suing a former sales executive claiming she violated its non-compete agreement.

Del Val Media Inc. filed a lawsuit Nov. 16 in U.S. District Court for the Eastern District of Pennsylvania against Christina Perrotta and TheHomeMagPhiladelphia, citing breach of contract, tortious interference, unfair competition and other counts.

The media group claims Perrotta was an employee with access to client and advertiser information. The complaint states Perrotta voluntarily quit her job and took a position at TheHomeMagPhiladelphia, a competitor, and began contacting Del Val clients in her new role. The media company claims this was a direct violation of their contract.

Del Val is seeking compensatory and punitive damages, an order imposing a constructive trust over any revenue received by the defendant from any clients solicited in violation of the non-compete agreement, enjoinment from TheHomeMagPhiladelphia employing Perrotta, identity of all clients and advertisers contacted by the defendant, as well as attorneys' fees, court costs, pre- and post-judgment interest, as well as any other relief the court deems fit, and a trial by jury.
