Independent Warehouse Inc. sues companies alleging breach of contract after withholding payments

PITTSBURGH – A safety supply distributor is suing a safety supply sales company alleging that it paid for products never received.

Independent Warehouse Inc., an Ontario-based company, filed a complaint on Oct. 22 in the U.S. District Court for the Western District of Pennsylvania against the Omni Group, a New Kensington-based company; Steamroll Product and Services Corp., doing business as Steamroll Products; Steamroll Holding Corp.; and Joseph M. Professori alleging breach of contract and fraud.

Independent Warehouse is a distributor of safety products and the defendant sells said safety products, the complaint states. Beginning in 2014, the defendant allegedly informed the plaintiff of numerous clients who were purchasing trailer stands. It was agreed that the stands would be shipped to the Independent Warehouse locations, additionally, the pricing was established and each party agreed to the terms, according to the complaint. Although the plaintiff fulfilled the shipping of the trailers, as stated, the defendant allegedly refused to pay the warehouse, claiming that it was waiting on payment from clients. Independent Warehouse is suing Omni, alleging that the actions were a breach of contract.

IWI is seeking compensation of $400,000, in addition to all losses for legal fees. They are represented by Wayne A. Graver of Lavin, O'Neil, Cedrone and Disipio in Philadelphia.
