Man sues Smith Management and Consulting over alleged failure to pay overtime

SCRANTON – A Cresco man is suing his employer after he alleges that he was denied overtime pay.

Francis Crevatas filed a class-action complaint on Nov. 30 in the U.S. District Court for the Middle District of Pennsylvania against Smith Management and Consulting LLC, alleging Fair Labor Standards Act and Pennsylvania Minimum Wage Act violations.

According to the complaint, Crevatas worked for the defendant and was classified as an independent contractor. He was paid a daily base rate for typically 12-hour days. Despite the fact the Crevatas and his co-workers regularly worked more than 40 hours per week, they allegedly never received extra compensation for their overtime work. The complaint also states that Crevatas and his co-workers should be classified as employees.

Crevatas is seeking compensation for all back pay, overtime and legal fees incurred. He is represented by R. Andrew Santillo and Peter Winebrake of Winebrake and Santillo LLC in Dresher and by Galvin B. Kennedy, Don J. Foty and John Neuman of Kennedy Hodges in Houston, Texas.
