Philadelphia worker accuses Rouge 98 of racism, unjust termination

PHILADELPHIA — A Philadelphia man is suing a local company, alleging his termination was due to racial discrimination and in violation of the Civil Rights Act.

Sterling David filed a lawsuit July 22 in the U.S. District Court for the Eastern District of Pennsylvania against Rouge 98 Inc. of Philadelphia, alleging violation of Title VII of the Civil Rights Act of 1964.

According to the complaint, David, an African-American male, was hired by Rogte 98 on June 4, 2013 as a sous chef and dishwasher. Although he maintained a professional and dedicated approach to his job, the suit states, he was subjected to racial discrimination and harassment from his co-workers.

The suit states the plaintiff was given unfavorable shifts and menial tasks, plus his supervisors did nothing to address the racism. On Dec. 29, 2013, the plaintiff complained of his treatment to his general manager and was terminated, the suit says.

David seeks damages for lost wages, benefits, compensatory damages, humiliation, mental anguish, court costs and attorney fees, plus a jury trial. He is represented by attorneys James A. Bell and Christopher A. Macey Jr. of Bell & Bell LLP in Philadelphia.
