New York passenger alleges Amtrak negligence led to his injuries

PHILADELPHIA — A passenger is suing Amtrak, alleging for injuries he suffered during a derailment.

Ryan Baum of New York filed a lawsuit July 10 in U.S. District Court for the Eastern District of Pennsylvania against the National Railroad Passenger Corporation, also known as Amtrak, alleging negligence.

According to the complaint, Baum was a passenger on Train 188, which was traveling from Washington D.C. to New York on May 12, 2015, and the route contains a dangerous portion of track that has warnings posted, in order to prevent incidents such as a fatal accident in 1943.

Despite the posted warnings, the suit says, the train maintained a velocity more than two times the limit. Upon taking a turn, the train derailed, throwing Baum from his seat and causing injuries to his head, neck, hips and shoulders, causing agony and suffering, the suit states. Eight people died and more than 200 were injured. 

Baum seeks compensation for all compensatory and punitive damages, as well as court costs and attorney fees. He is represented by James Christopher Munley of Munley Law PC in Scranton.
