Gender discrimination case against West Pharmaceutical Services closed

PHILADELPHIA — The case of a former employee who sued an Exton pharmaceutical business, alleging discrimination and wrongful termination, has been closed.

Clara Goodfield of Newburgh, New York, first filed a lawsuit on Feb. 18, 2016 in U.S. District Court for the Eastern District of Pennsylvania against West Pharmaceutical Services Inc., alleging citing violations of Title VII and the Pennsylvania Human Relations Act.

According to the complaint, Goodfield was initially employed by West Pharmaceutical from 2002 through 2011, when she left voluntarily for another opportunity before returning around 2013. The suit says after continued and persistent sexual harassment by her supervisor, the plaintiff engaged in a sexual relationship with him.

In May 2014, after the company became aware of the relationship, Goodfield states she was terminated. The plaintiff argues that her male superior was not terminated and that she was a victim of gender discrimination.

In August 2014, the plaintiff filed a charge and subsequently amended charge with the Equal Employment Opportunity Commission (EEOC), granting her right to sue for her complaint.

Subsequently, court records indicate that a settlement was reached between the parties on June 6, 2016. Terms of the settlement were not disclosed, however, it was noted the case was ended with prejudice. A 90-day extension to, for cause shown, vacate, modify, or strike the agreement from the record was extended up to and including Nov. 4, 2016. However, the docket reflects no further activity since that time.

Goodfield had initially sought compensatory damages for all past and future lost earning, benefits, and earning capacity, costs of the action and punitive damages. She is represented by attorneys Stephen G. Console and Caren N. Gurmankin of Console Law Offices in Philadelphia.
