PITTSBURGH — An insurance company is suing a trucking company, alleging it damaged goods during transport and failed to pay for the damages.
Great Northern Insurance Company, as subrogee of Taktl LLC, filed a lawsuit on March 24 in the U.S. District Court for the Western District of Pennsylvania against Sparta Transport Inc., citing violation of the ICC Termination Act.
At all time relevant to the case, Great Northern Insurance Company provided insurance to Taktl LLC, located at 1120 William Flynn Highway in Glenshaw. On Feb. 6, 2015, the defendant allegedly traveled to the insured location to pick up a shipment of building materials.
The plaintiff claims that the shipment was in good condition at the time of departure but was damaged when it arrived in Hayward, California. The plaintiff’s insured submitted a claim for the damages in the amount of $100,000. The defendant has allegedly denied the demand for compensation in accordance with the ICC Termination Act.
Great Northern Insurance Company seeks judgment in the amount of $100,000, interest, costs of the action, and a trial by jury. It is represented by John A. Robb, Jr. and R. Douglass Klaber, Jr. of Robb Leonard Mulvihill LLP, in Pittsburgh, and Christopher H. Boyle of Cozen O’Connor, in Philadelphia.
