Two women say Johnstown Dairy Queen violated wage law

PITTSBURGH — Two women have filed a class-action suit against a restaurant in an overtime-pay claim, citing alleged unjust enrichment, unpaid wages, and violation of workers compensation acts.

Sarah Faust and Ashley Hughes sued Stralco Inc., doing business as Dairy Queen Grill and Chill Restaurant in Johnstown, on May 19 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendants violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs alleges that, between October 2013 and 2015, Sarah Faust and Ashley Hughes did not receive overtime premium for all hours they worked over 40 per week. The plaintiffs hold the defendant responsible because the defendant allegedly altered and reduced the number of hours they worked per week and failed to compensate them for all hours worked in excess of 40 per week at a rate of at least one and one-half time of their regular rate, failed to maintain accurate time records and required them to work 45 hours per week, or suffer reduction in pay.

The plaintiffs request a trial by jury and seek an order permitting this litigation to proceed as a collective action, compensation for damages, unpaid wages, pre-judgment interest, liquidated damages, litigation costs, expenses and attorneys’ fees and such other and further relief as the court deems just and proper.
