PITTSBURGH — A man is suing Norfolk Southern Corp., his former employer, citing alleged retaliation and wrongful termination.
Keith Lavorgna filed a complaint on April 22 in the U.S. District Court for the Western District of Pennsylvania against Norfolk Southern Corp., alleging that the former employer allegedly violated the Family and Medical Leave Act.
According to the complaint, the plaintiff alleges that he made a request for an FMLA leave but the defendant leveled false allegations regarding falsified documents against him and, pursuant to that, he was terminated on September 8, 2015. The plaintiff holds Norfolk Southern Corp. responsible because the defendant allegedly refused to work with him in properly utilizing FMLA leave, charged him with falsifying company documents via the FMLA paperwork and terminated him because of a disability.
The plaintiff requests a trial by jury and seeks judgment against defendant for loss of back wages in excess of $60,000, loss of future wages in excess of $250,000, punitive damages in excess of $75,000, legal fees, pre-judgment and continuing interest, court costs and other such relief as the court may deem just and proper.
