Couple's lawsuit says man drove negligently

HARRISBURG — A Florida couple's lawsuit against a Hazleton resident blames the defendant for allegedly causing a rear-end collision.

Lupe Gallucci and Daniel Gallucci filed a complaint on April 22 in the U.S. District Court for the Middle District of Pennsylvania against Michael Wilfing, alleging that the Hazleton resident allegedly violated numerous applicable provisions of the Pennsylvania Motor Vehicle Code.

According to the complaint, the plaintiffs allege that on August 8, 2014, Lupe was a front seat passenger in a 2011 Toyota Camry being operated by her husband, Daniel, when it was forcibly and negligently rear-ended by the defendant's motor vehicle. The incident caused serious and permanent bodily injuries to Lupe and compensable damages to her husband, the suit says. The plaintiffs holds Michael Wilfing responsible because the defendant allegedly failed to keep his vehicle under proper and adequate control, violated the assured clear distance ahead rule, drove too fast, failed to keep proper lookout and failed to timely and properly stop his vehicle,.

The plaintiffs request a trial by jury and seek judgment against defendant for an amount in excess of $75,000. They are represented by John R. Lenahan, Jr. of Lenahan & Dempsey PC in Scranton.
