PHILADELPHIA — A former employee is suing Multi-Flow Industries LLC, a fountain beverage provider, claiming wrongful termination and alleging that he was not properly compensated for overtime.
Aleksandr Mushiyakh filed a complaint on May 18 in the U.S. District Court for the Eastern District of Pennsylvania against Multi-Flow Industries LLC, alleging that the fountain beverage provider violated the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.
According to the complaint, the plaintiff alleges that he worked for the company from March 2004 until March 16 of this year, and that at various times he was not paid overtime for working more than 40 hours per week. He also claims he was terminated for filing a workers' compensation claim. He alleges that he suffered loss of wages and earnings, loss of benefits, mental anguish, emotional distress and humiliation. The plaintiff holds Multi-Flow Industries LLC responsible because the defendant allegedly failed to compensate him at the rate of one and one-half of his regular rate for all hours worked in excess of 40 per week, failed to keep appropriate time records, and retaliated and terminated his employment for filing a workers' compensation claim.
The plaintiff requests a trial by jury and seeks a declaration that defendant violated the FLSA, compensation for unpaid wages, liquidated damages, attorneys' fees and costs and for such other relief as the court may deem proper.
