Man claims incorrect HIV diagnosis

PHILADELPHIA — A man is suing the federal government and Shubhra Shetty, M.D., alleging negligence and insufficient measures taken to prevent injuries.

Miguel Gonzalez filed a complaint on July 1 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they failed to properly diagnose plaintiffs condition.

According to the complaint, the plaintiff alleges that in 1998, he sustained significant damages to his life as a result of being misdiagnosed with HIV. The plaintiff holds the United States of America and Shetty responsible because the defendants allegedly failed to carefully examine the plaintiff's condition before declaring that he was HIV positive.

The plaintiff seeks medical expenses and compensation for pain and suffering in the amount of $20,000,000, court costs and any further relief the court grants. He is represented by Samuel A. Anyan Jr. of Wapner, Newman, Wigrizer, Brecher & Miller in Philadelphia.
