Labor secretary alleges failure to pay overtime

HARRISBURG — The U.S. Labor Department secretary is suing Bristol Excavating Inc. and company owner Calvin Bristol, alleging failure to pay proper overtime.

U.S. Secretary of Labor Thomas E. Perez filed a complaint on July 22 in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendants failed to fairly compensate employees for all hours worked.

According to the complaint, the plaintiff alleges that employees were not paid a proper overtime premium at the legal rate.

The plaintiff seeks to permanently enjoin and restrain the defendant plus an order for back wage compensation, liquidated damages and court costs. The plaintiff is represented by M. Patricia Smith, Oscar L. Hampton III and Bertha M. Astorga of the U.S. Department of Labor in Philadelphia.
