PHILADELPHIA — A woman is suing Hartford Life and Accident Insurance Company and Flowers Foods Inc., insurer and plan administrator, citing alleged breach of contract and violation of the Employee Retirement Income Security Act.

Linda M. Smith filed a complaint on Aug. 2 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they improperly terminated her long-term disability benefits.

According to the complaint, the plaintiff alleges that on April 24, 2013, she became disabled and was approved and initially being paid for disability benefits until they were terminated on Feb. 22, 2016. The plaintiff holds the defendants responsible for allegedly terminating her disability benefits despite having sufficient medical documents to support her claim.

The plaintiff seeks payment of past and future long-term disability benefits, damages, penalties, court costs and any further relief the court grants. She is represented by Kenneth D. Berman and William J. Fox of Law Office of Kenneth D. Berman in Philadelphia.
