Employee blames Amtrak for back, shoulder injuries

PHILADELPHIA — An employee is suing National Railroad Passenger Corporation (Amtrak), alleging negligence, insufficient measures taken to prevent injuries and violation of federal law.

Miguel V. Colon filed a complaint on Aug. 15 in the U.S. District Court for the Eastern District of Pennsylvania against Amtrak, alleging that the employer failed to provide him with the proper equipment to move a heavy object in the course of his employment.

According to the complaint, the plaintiff alleges that in March, he sustained serious physical injuries when he injured his back and shoulder from manually pulling a train jack. The plaintiff holds the defendant responsible because it allegedly failed to provide him and other employees with adequate machinery to assist them in moving the train jack.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in excess of $150,000. He is represented by Michael J. Olley of Coffey Kaye Myers & Olley in Bala Cynwyd.
