Woman alleges LINA wrongfully terminated disability benefits

Insurance 06

ERIE – A Pittsburgh woman alleges that her insurance firm wrongfully terminated disability benefits.

Juanita Conner filed a complaint on Sept. 8 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in April 2012, she became disabled due to several medical conditions, including a chronic kidney disease and stroke, and was initially being paid disability benefits until benefits were terminated on Sept. 25, 2014.

The suit states that the defendant terminated the benefits under the belief the plaintiff could work in another capacity. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny further benefits to plaintiff despite medical evidence and alleges the defendant did not provide a full and fair review.

The plaintiff seeks award all relief plaintiff is entitled to under ERISA, interest, court costs and any further relief the court grants. She is represented by Brian Patrick Bronson of QuatriniRafferty PC in Greensburg.
