K-Mart Corporation blamed for injuries from fall

PITTSBURGH — A woman is suing K-Mart Corporation, alleging negligence and insufficient measures taken to prevent injuries.

Dawn Gurtner filed a complaint on Oct. 11 in the Court of Common Pleas of Allegheny County against K-Mart Corporation, alleging that the store failed to properly maintain the floor of its store free of any foreign substance that could cause an accident.

According to the complaint, the plaintiff alleges that on June 11, she sustained physical injuries when she slipped and fell due to a foreign substance that was left on the floor. The plaintiff holds K-Mart Corporation responsible because the defendant allegedly allowed the dangerous condition and failed to properly warn her regarding the slippery substance on the floor.

The plaintiff seeks judgment against the defendant in an amount in excess of $35,000 but not to exceed $75,000 plus court costs. She is represented by Marc I. Simon of Simon & Simon, PC in Philadelphia.
