BMI, others accuse The Orchards of performing music without license

SCRANTON – The owners of several songs allege a Chambersburg business has been performing their songs without authorization.

Broadcast Music Inc., et al. filed a complaint on Nov. 18 in the U.S. District Court for the Middle District of Pennsylvania against The Orchards Corp., doing business as The Orchards, and Michael Kalathas, Konstantino Kalathas and Alexandria Kalathas, alleging copyright infringement.

According to the complaint, the plaintiffs allege that the defendants have been using their musical compositions. The plaintiffs hold The Orchards Corp., Michael Kalathas, Konstantino Kalathas and Alexandria Kalathas responsible because the defendants allegedly continued to use plaintiff's musical compositions for public performance despite the plaintiffs informing them 167 times since 2009 to purchase a license.

The plaintiffs seek to enjoin the defendants, pay statutory damages, court costs and any further relief the court grants. They are represented by Stanley H. Cohen of Caesar Rivise, PC in Philadelphia.
