Man alleges FedEx rescinded employment offer because of misdemeanor history

PITTSBURGH – A Pittsburgh man alleges he was wrongfully denied an offer of employment because of his criminal record.

Dominic Ceraso filed a complaint Dec. 2. in the Court of Common Pleas of Allegheny County against FedEx and NexTech Solutions alleging wrongful discharge.

According to the complaint, the plaintiff began working at FedEx in June 2016 as an onsite vendor through NexTech. The suit states a drug test and background check was completed as a result of this, and that this background check listed three misdemeanors. He alleges he explained to the history to the hiring manager and was approved and cleared to work.

The suit states he was encouraged to apply for an opening with FedEx in September 2016 and after applying, received an offer letter on Sept. 29, 2016. Another background check was completed and the suit states that on the plaintiff's last day with NexTech on Nov. 1, 2016, FedEx rescinded its employment offer.

The plaintiff seeks judgment against the defendant for the loss of future earnings of more than $200,000, damages worth $10,000, court costs of $25,000 interest and any further relief the court grants. He is represented by Christi Wallace of Kraemer, Manes and Associates LLC in Pittsburgh.
