PHILADELPHIA – A man has filed legal action against a Bethlehem healthcare facility and its operating companies, where he says that he slipped and fell from an accumulation of ice and snow nearly two years ago.
Walter Frazier of Allentown filed suit on Jan. 26 in the Philadelphia County Court of Common Pleas, versus HCR Manor Care, HCR Manor Care, Inc., Manor Care, Inc., Manor Care Of America, Inc., Manor Care Health Services, Inc. and Manor Care Health Services – Bethlehem (2021), all of Toledo, Ohio, plus HCR Manor Care Properties, LLC, Manor Care Of Bethlehem PA (2021), LLC, Manor Care Of Bethlehem PA (2029), LLC and Manor Care Health Services – Bethlehem (2029), all of Philadelphia, in addition to Manor Care Nursing Home, Manor Care Health Services – Bethlehem II and MCHS Bethlehem, all of Bethlehem.
“On or about Feb. 16, 2015, plaintiff, was an invitee, licensee and/or otherwise legally on defendants’ premises, when, as a result of the negligence and/or carelessness of the defendants, a dangerous and or defective condition caused the plaintiff to slip and fall due to ice and snow on the premises,” the suit says.
The plaintiff believes the defendants failed to inspect, maintain or repair the floor from its dangerous and defective condition, and suffered “various serious and permanent personal injuries, serious impairment of body function and/or permanent serious disfigurement, and/or aggravation of pre-existing conditions”, including several vertebral bulges and herniations, cervical radiculopathy, lumbar radiculopathy, right ulnar nerve impairment and other injuries in the fall.
The plaintiff is seeking damages in excess of $50,000, plus attorney’s fees, costs and other relief.
