PHILADELPHIA — A husband and wife are suing Hartford Mutual Insurance Co., citing alleged breach of contract.

Joseph S. Franklin and Kathleen Franklin filed a complaint on March 1 in the U.S. District Court for the Eastern District of Pennsylvania against the insurance company alleging that it failed and refused to agree on the amount of benefits owed.

According to the complaint, the plaintiffs allege that in June 2015, Joseph Franklin experienced  injuries from being involved in a car accident involving an underinsured motorist. The plaintiffs holds Hartford Mutual Insurance Co. responsible because the defendant allegedly refused to pay the agreed amount claimed by the underinsured motorist on behalf of the plaintiff.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds $75,000. They are represented by Bernard M. Gross of Law Offices of Bernard M. Gross PC in Philadelphia.
